Form I-797 Approval Notice

A Form I-797 Approval Notice is issued when an Immigrant or Nonimmigrant Petition or Application is approved. The Approval Notice is an important document that should be maintained with a foreign national's immigration-related paperwork. It is often used as proof of status.


Immigrant Petition

The form on which an employer or family member sponsors a foreign national for Lawful Permanent Resident (Green Card) status.


Nonimmigrant Petition or Application

Any form that is filed with USCIS (formerly the INS) to request authorization to remain in the U.S. for a temporary period.


Form I-824 Application for Duplicate Approval Notice

Form I-824 application is appropriate for individuals who have lost their Form I-797 Approval Notice or who never received the Approval Notice from United States Citizenship and Immigration Services (USCIS). If you have lost the Form I-797 Approval Notice issued in connection with an Immigrant Petition or Nonimmigrant Petition or Application, you may file form I-824 Application for a Duplicate Approval Notice. This duplicate approval notice application does not cover requests to replace an Employment Authorization Card, Permanent Resident Card (Green Card), or Form I-94. The Form I-824 application only replaces the I-797 Approval Notice.

If you filed an application or petition with USCIS that was approved, but you never received the Approval Notice, then you may file form I-824 Application for a Duplicate Approval Notice. This is only necessary in cases where USCIS records indicate that the Approval was sent to your address, but you never received it. If USCIS records indicate that the Approval Notice was never mailed, then you can request that USCIS send you the Approval Notice.

In order to apply for a Duplicate Approval Notice, you must be the Applicant or Petitioner of the original Application or Petition.
