B-1/B-2 Visitor Visa Application

The B-1/B-2 Visa is used by foreign visitors who enter the U.S. for a temporary period for business or pleasure. A B-1/B-2 visa is generally valid for six months and can be extended once the visa holder is in the U.S.

A B-1/B-2 visa is the most commonly used U.S. visa. It authorizes a fairly wide range of activities, and individuals who enter the U.S pursuant to this status are generally authorized to change to a status that authorizes work or study after entering the U.S. For more information, click here to purchase our informative How to Get a Student & Tourist Visa DVD.

Qualifying B-1/B-2 visa holders are even authorized to adjust status to Lawful Permanent Resident (apply for a Green Card) after they have entered the U.S. Because of this, individuals who would otherwise be eligible to enter the U.S. without a visa (pursuant to the Visa Waiver Program) may choose to go through the process of applying for a B-1/B-2 visa instead. (Individuals who enter the U.S. pursuant to the Visa Waiver Program are not authorized to change or extend status in the U.S.)

Business

A B-1 visa is granted to business visitors who wish to enter the U.S. for a temporary period to engage in legitimate business activities, such as meetings, conferences, negotiating contracts and consultations. B-1 visa holders may not work in the U.S. and may not be paid from a U.S. source. Individuals who seek to work in the U.S., should apply for a work visa, such as an H-1B, TN or L-1 visa.

Pleasure

A B-2 visa is granted to visitors who wish to enter the U.S. for a temporary period to engage in tourist activities or visit families or friends. In addition, in certain situations, a B-2 visa may be issued to individuals who will accompany a spouse or partner who holds another visa status.

The process of applying for a B-1/B-2 visa involves careful preparation and strategy. It is important to present a flawless application the first time, since it becomes very difficult, if not impossible, to successfully obtain a B-1/B-2 visa if you have previously been denied a visa. Mistakes and miscalculations in the visa application process can make you permanently ineligible to visit the U.S. pursuant to a valid visa.
