The United States has always been a culturally motivated country for business. If a US company UU. Looking to hire a foreign employee and provide a work visa, the company must submit Form I-140. There are five preferential categories. Some require a labor certification from the Department of Labor in addition to Form I-140.
E1: Workers with priority
This category represents 28.6% of the total annual quota of 140,000 employment-based visas. To enter this category, you must be one of the following people:
- A person with extraordinary skills in science, art, education, business or sports.
- An outstanding professor or researcher with three years of experience.
- An executive or manager of a multinational who has been employed for one of the previous three years by the subsidiary, the parent company, the subsidiary or the foreign branch of the US employer.
E2: Professionals with advanced degrees and people with exceptional skills
This category represents 28.6% of the annual quota. This category requires that the employer obtain a labor certification approved by the Department of Labor. In some cases, applicants may request a waiver to file Form I-140 on their own. To enter this category, you must be one of the following people:
- A professional with an advanced degree or a professional with a bachelor’s degree and at least five years of experience.
- A person with extraordinary skills in science, art or business.
E3: Specialized workers, professionals and non-specialized workers
This category represents 28.6% of the annual quota and here the employer is also required to obtain a labor certification. To enter this category, you must be one of the following people:
- A specialized worker whose work requires a minimum of two years of training or work experience.
- A professional whose work requires at least a bachelor’s degree from a university or US faculty. UU.
- A non-specialized worker who can occupy a position that requires less than two years of training or experience and is not temporary or seasonal.
E4: Certain special immigrants
This category represents 7.1% of the annual quota. Applicants must have approved a Form I-360: Petition for Amerasiatics, Widower, or Special Immigrant. There are many subgroups to which you can belong. Below are some examples:
- presenter;
- religious minister;
- Iraqi or Afghan interpreter;
- surviving spouse of a deceased employee of an international organization;
- foreigner graduated in medicine.
E5: Immigrant investors
This last category is for foreign investors with capital investments in new business projects in the US. UU. that will provide new jobs for US citizens.
