If you’re planning to apply for a green card (adjustment of status), mark your calendar: September 18, 2026 is a hard deadline you cannot afford to miss.
What’s Changing
On September 18, 2026, USCIS will publish a revised edition of Form I-485, Application to Register Permanent Residence or Adjust Status, carrying an edition date of 09/18/26. The revision isn’t cosmetic — it’s directly tied to the new Public Charge Ground of Inadmissibility Final Rule, which takes effect the very same day and requires adjustment-of-status applicants to disclose prior use of means-tested public benefits. That final rule was formally published in the Federal Register on July 20, 2026.
The Part Everyone Needs to Pay Attention to: No Grace Period
Normally, when USCIS rolls out a new form edition, applicants get a window of weeks or months where either the old or new version is accepted. Not this time.
- USCIS will accept the 01/20/25 edition of Form I-485 only if it’s postmarked or electronically submitted before September 18, 2026.
- Any 01/20/25 edition postmarked or submitted on or after September 18, 2026 will be rejected outright.
- Conversely, USCIS will only accept the 09/18/26 edition if it’s submitted on or after September 18, 2026 — filing it early gets it rejected too.
In other words, there’s a single-day cliff. File the right form on the right side of that line, or your case bounces.
Why the Timing Matters So Much
Before September 18, 2026, USCIS officers will continue applying the narrower 2022 public charge standard. From that date forward, officers will factor in all means-tested public benefits when evaluating an application. So this isn’t just a paperwork swap — the substantive legal standard used to evaluate your case shifts on the same day.
As one immigration attorney put it, filing the wrong edition doesn’t count as a formal denial that goes on your record, but it can still delay your case by weeks while you refile correctly.
What This Means for You
- Filing before Sept. 18? Use the current 01/20/25 edition — but leave yourself buffer time in case of mailing or processing delays.
- Filing on or after Sept. 18? You must use the new 09/18/26 edition and be prepared for the new public charge disclosure requirements.
- Filing right around the cutoff? This is the riskiest window. A packet that’s postmarked too early with the new form, or arrives too late with the old one, gets rejected either way.
USCIS has also announced parallel changes for other forms — including new editions of Form I-539 and Form I-765, with their own Sept. 15, 2026 cutoff and no grace period either — so if your green card application involves related filings (like work authorization), those deadlines matter too.
